Please read these Terms of Service and Privacy Policy ("Terms") carefully before purchasing or accessing any online course, digital product, recipe book, webinar, or coaching service offered by My Plant Cake. By checking the "I accept Terms of Service and Privacy Policy" box at checkout  or by accessing our platform, you ("Student", "Customer", or "you") agree to be legally bound by these Terms. 

1. DIGITAL PRODUCTS & IMMEDIATE ACCESS

Upon completing your payment (whether in full or via an installment payment plan), you are granted immediate access to our proprietary digital learning platform, course videos, downloadable PDF recipe books, and preparatory materials (including ingredient and equipment lists) . 

  • Pre-Cohort Access: Even if a course includes live or one-to-one support starting on a specific cohort date, the digital intellectual property is delivered immediately upon purchase. Logging into the platform or opening course files constitutes full delivery and consumption of the digital product. 

2. STRICT NO REFUND POLICY ("ALL SALES ARE FINAL")

Because our courses provide immediate access to downloadable and streamable digital intellectual property, proprietary recipes, and trade secrets, all sales are final and non-refundable . 

  • No Refunds for Experience Mismatch or Buyer’s Remorse: Our curriculum descriptions and website FAQ clearly outline the skill levels covered in each program. We do not issue refunds if a Student determines after accessing the platform that they are already familiar with certain techniques, ingredients, or recipes, or if their personal financial circumstances change.

  • No Course Transfers: Purchasing a specific course grants access solely to that program. Enrollment in advanced programs (such as the Unicorn Course) is subject to strict prerequisites (including prior graduation from the Fundamental Course)  and cannot be substituted or transferred upon request. Purchasing the Fundamental Course provides a special discount toward future mini-courses and the Unicorn Course, not a complimentary transfer . 

  • Exceptional Settlements & Processing Fees: In the rare event that the Company, at its sole and absolute discretion, agrees in writing to grant an exceptional cancellation prior to cohort commencement, any approved refund will strictly exclude non-refundable third-party payment processing and credit card transaction fees incurred during the original payment . 

3. CHARGEBACKS & PAYMENT DISPUTES

You agree not to initiate unjustified chargebacks or payment disputes through your bank, credit card provider, or Apple Pay/PayPal after accessing our digital platform.

  • Activity Logging: Our platform (hosted on Kajabi) automatically records Customer Progress Reports, login timestamps, IP addresses, video completion rates, and lesson access logs across all modules. 

  • Dispute Contesting: In the event of a chargeback attempt, the Company will submit this Terms of Service agreement, checkout disclosures, platform access logs, and all email/messenger correspondence to the financial institution to contest the dispute as digital friendly fraud. Furthermore, your access to all My Plant Cake platforms and communities will be permanently revoked.

4. INTELLECTUAL PROPERTY & COPYRIGHT RULES

All course materials—including manuals, recipes, ingredient ratios, presentations, handouts, teaching aids, videos, sound recordings, and graphics (collectively, "Course Materials")—are the copyrighted intellectual property of My Plant Cake . Violation of these copyright terms is a violation of US federal law and international copyright treaties. 

What IS Allowed (Commercial Bakery Use):

  • You are permitted to include the desserts and recipes learned in our courses into your own physical bakery, store, or café menu . You may bake and sell the physical desserts based on our recipes directly to your customers. 

What is STRICTLY FORBIDDEN:

  • You may NOT publish, post, or share our written recipes or videos online, on social media, or on blogs. 

  • You may NOT distribute or share the recipes with third parties (whether via printed handouts, e-books, or your own published books). 

  • You may NOT use, adapt, or reproduce our recipes, videos, or methodology to teach in your own online school, masterclasses, webinars, or live/on-site culinary classes without prior written permission from My Plant Cake. 

When customers ask about the origin of a recipe, you may credit: "This recipe is courtesy of online school @MyPlantCake www.myplantcake.com" without disclosing the recipe text or ratios. 

5. ALLERGY & DIETARY DISCLAIMER

Our plant-based and raw dessert courses extensively utilize tree nuts and coconut products, including almonds, cashews, hazelnuts, walnuts, and coconut ingredients. By enrolling, you acknowledge this requirement. If you require substitutions for 1–2 of these ingredients (though not all can be substituted simultaneously), you must contact us via email for individual guidance. My Plant Cake is an educational culinary school and is not responsible for allergic reactions or cross-contamination in desserts prepared by Students. 

6. COURSE ACCESS DURATION & SUPPORT RULES

  • Access Duration: Standard course access is granted for the period specified on your checkout page at the time of purchase (e.g., 6 months, or 2 years for promotional packages), with the option to extend access via annual membership or lifetime upgrades. 

  • Support Guidelines: For packages that include 1-on-1 email and WhatsApp support with Chef Olga, support runs for the designated 6-week educational window (excluding weekends) starting from the official cohort date . We reserve the right to terminate support and revoke platform access without refund if a Student engages in abusive, disrespectful, or harassing communication toward the instructor or staff. 

7. GOVERNING LAW & VENUE

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States of America, without regard to its conflict of law principles. Any legal suit, action, or proceeding arising out of or related to these Terms or your purchase shall be instituted exclusively in the federal or state courts located in the State of Florida.

PRIVACY POLICY

My Plant Cake respects your privacy and is committed to protecting your personal data.

  1. Information We Collect: When you subscribe to our newsletter, download free resources, or purchase a course, we collect your name, email address, billing information, phone number (for WhatsApp support), and platform usage data (lesson progress and login history) . 

  2. Payment Security: All payment transactions are encrypted and processed securely through third-party PCI-compliant gateways (such as Stripe, Apple Pay, Google Pay, and Afterpay) . We do not store your full credit card numbers on our servers. 

  3. How We Use Your Information: We use your data to deliver course access, provide student support via email and WhatsApp, track course completion for certification, and send educational or promotional emails via Mailchimp (from which you may unsubscribe at any time) . 

  4. Data Sharing: We do not sell, rent, or trade your personal information to third parties. Data is shared only with essential service providers required to operate our school (e.g., Kajabi, payment processors, and email delivery systems).
